Police and courts are working hard to crack-down on the possession and distribution of illegally obtained prescription narcotics. Police will look to determine if a prescription exists for the person who is found to have them on him or her. If so, they may investigate to see if the prescription was forged. If not, they will investigate how the drugs were obtained. Police take illegal prescription possession and distribution very seriously as most of the narcotics in question are just as powerful and dangerous as street drugs. These prescription drugs may include:
- Psychoactive drugs
- Anti-anxiety medication
Police will use prior knowledge and street experience to determine what drugs are classified as potentially suspect and how dangerous the outcomes of use and distribution will be on an individual or community.
It is illegal to be caught with a forged prescription or a prescription for medication that does not belong to you. In the case of the latter, if you are caught with prescription medication it is the prerogative of the attending police officer to investigate the validity of the prescription on hand.
Some prescriptions are highly controlled. These include drugs such as:
- Benzodiazepines (Ativan, Valium, Xanax)
- Codeine (Robitussin A-C, Tylenol C)
- Oxycodone (Percocet, Oxycontin, Vicodin)
- Amphetamines (Dexedrine, Adderall)
- Methylphenidate (Ritalin)
- Dextromethorphan (Robitussin)
You may be charged with drug trafficking or possession with the intent to distribute. In the case of the former, you will be charged if police have established enough evidence to indicate that you have already sold illegal prescription drugs to a third party. In the case of the latter, intent to traffic can be inferred where the quantity, purity, and/or value of drugs.
